I agree to abide by all membership rules and regulations of the club. I agree to comply with stated and customary rules for participation and use of equipment. I am responsible for all payments due and owing under this membership agreement, even if I do not use our facilities and services. However, in the event of death or disability, liability for fees will terminate as of the date of death or disability. If the facility becomes temporarily unavailable due to an event such as fire, flood, loss of lease, or the like, the club will extend my membership privileges for the period the facilities are unavailable.
Late Fees: I agree to pay a $20.00 late fee if my monthly payment is received more than ten (10) days past the due date. I also agree to pay any fees associated with returned payments or non-payments of dues. I agree to pay all costs of collection, including agency fees, court costs, arbitration costs, and reasonable attorney fees, which may be paid or incurred by the club. I agree that Edge Fitness or a third party and their agents and assigns may send communications to me via email, including late payment notifications, solicitations, and other correspondence. If my membership becomes delinquent past a 90-day period, my membership payments may be accelerated to the total amount of the membership due under this agreement.
Membership Assumption of Risk and Release: I understand the risk of injury by engaging in club activities and using any club equipment, including the potential risk for permanent paralysis and death. I knowingly and freely assume all such risks, both known and unknown. I acknowledge and I assume all risks associated with using exercise equipment. I hereby release Edge Fitness and their respective owners, officers, affiliates, agents, employees, other participants, sponsoring agencies, sponsors, advertisers, and, if applicable, owners and lessors of premises used to conduct any sponsored event of any responsibility w
I agree that I understand how to use all of the equipment or will be taught how to use the equipment, as well as all exits and security devices. I understand the risks associated with using exercise equipment and exercising alone without the aid of a trainer, supervisor, or the presence of club staff on the premises. I hereby release and indemnify Edge Fitness, its officers, owners, agents, employees, instructors, and their insurers from and against any liability that may arise out of or in connection with my use of any of the equipment or the facilities of the club or if any incident occurs while using the club’s facilities or otherwise related to my club membership.
I expressly agree that this release is intended to be as broad and inclusive as permitted by the laws of this state, and if a portion of this release is held invalid, the balance shall remain in full force and effect. This release shall apply to my heirs and assigns, and, in the case of a family membership, to any minor included in my membership and on whose behalf I hereby sign as parent/guardian. I understand that the club is relying on this release in agreeing to enter into this agreement.
I agree not to invite any non-members into the club or to give my access card to anyone. If I let in non-members or lend my access card to a non-member, I recognize that Edge Fitness may charge my account $10.00 per person per time. I am aware that these instances of inviting non-members or lending my access card to non-members will count as a first warning for membership termination. If I am visiting the center with other members, I agree to always scan my access card to avoid confusion and/or a warning.
Membership Transfer: I have no right to assign or transfer my membership rights to any other person.
Security: Edge Fitness is under 24/7 camera surveillance, but this system does not protect me from harm in or around the building premises. I understand that I must use caution when entering or leaving the building and that I must notify the club if I feel threatened or witness suspicious activity. I will not allow access to individuals who knock on the door, as this could put members at risk. If I allow access to anyone without an access card, my membership may be terminated immediately with no refund of membership dues.
Members Right to Cancel
Early Cancellation Option: If I wish to cancel this contract, I may cancel by delivering or mailing a written notice to the club. The notice must say that I do not wish to be bound by the contract, and it must be delivered or mailed before midnight of the seventh business day after I sign this contract. If I cancel my membership, I must return all club materials, include the key fob, in order to stop auto payments.
Medical Cancellation: I may cancel this agreement for medical reasons. My doctor must provide certification that my use of the club’s facilities and services would impair my health.
Relocation Cancellation: I may cancel this agreement by written notice to Edge Fitness if I permanently move my residences out of the area. I understand that I will need proof of relocation.
I understand that cancelation is still required even after my contract date has past. After my contract date has passed, my membership will continue on a month-to-month basis and will require 30 day’s written notice to Edge Fitness of my membership cancelation. If I terminate the agreement or stop the automatic debit arrangement in a manner not described in the agreement, then I may be responsible for a breach of contract with Edge Fitness.
Tanning: By signing this agreement, I hereby assume all risks associated with Edge Fitness tanning activity and hereby knowingly and voluntarily waive any and all claims and causes of action against Edge Fitness, its employees, representatives, and agents arising from any injuries sustained during or in connection with the use of the tanning beds in the Edge Fitness centers.
I have read this release of liability and assumption of risk agreement, and I understand its terms of services. I understand that I have waived my rights by signing it, and I sign it freely and voluntarily without any inducement. I verify that all the information I provided is accurate to the best of my knowledge and that I do not have any medical issues or diseases that could become worse by engaging in facility activities or that could harm others.
For Parent or Guardians
As parent and/or guardian of a minor, I hereby agree to be fully responsible for any and all actions, damages, injuries, or loss to property or person performed by the minor with or without club supervision inside or outside of the club.
